In response to the implementation of amendments to certain provisions of the Trademark Act on May 1, 2024, as well as revisions to the Enforcement Rules of the Trademark Act and the Regulations Governing Trademark Agent Registration and Management, TIPO has updated the Article-by-Article Interpretation of the Trademark Act.
This revision also takes into account updates to examination guidelines issued over the past three years, including:
Examination Guidelines on Likelihood of Confusion,
Examination Guidelines on Distinctiveness of Trademarks,
Examination Guidelines on Disclaimers,
Examination Guidelines on Certification Marks, Collective Trademarks and Collective Membership Marks.
The updated interpretation incorporates adjustments reflecting changes in judicial practices. It includes selected judicial rulings and examination practice insights of high reference value to enhance the completeness of the article-by-article interpretation. Stakeholders are encouraged to refer to this resource.
