JIEPAO outruns Jaguar in trademark similarity case

Three years after the start of the scuffle, the China Trademark Office (TMO) under the State Administration for Industry and Commerce (SAIC) made a ruling denying luxury auto maker Jaguar Cars Limited Company’s (Jaguar) claim and registered the four trademarks of  “捷跑JIEPAO” recently.


Xu Li established Sichuan Jiepao Taxi Limited Company (Jiepao) in 2003 and applied for five trademarks of “捷跑JIEPAO” in September 2004. Jaguar requested the TMO to revoke the registration of the four trademarks of “捷跑JIEPAO”, certified to be used in Class 12,35,37 and 39 on March 12, 2008.


The TMO held the trademarks “捷跑JIEPAO” and “捷豹JIEBAO”、“JAGUAR” were designated goods with significantly distinctive functions and uses . No similarity is established. So ordered.
