JACK&JONES awarded 1.9 million yuan over domain name dispute

Beijing Haidian district court entered into the first-instance judgment on a domain name dispute, awarding an injunction and 1.9 million yuan in damages recently. The court ordered the defendants discontinue the use of the domain name www.jackjonescn.net and ceasing distribution of the clothes with the logo of JACK&JONES.
Bestseller Fashion Group (Tianjin) CO., LTD (Bestseller ) discovered the defendants registered the website and sold the infringing products with JACK&JONES’s registered marks in 2008. Bestseller then brought the case to the court.
The court held that the public might easily be led to believe there was certain association between the clothes on the site. Moreover, the two defendants traded cumulative 2.8 million yuan from January 2008 to February 2010.The court took the view that the defendants infringed JACK&JONES’s registered trademark and so orederd.
